جزئیات جدید از آخرین وضعیت لایحه پلیس ویژه اطفال
سخنگوی کمیسیون قضائی مجلس شورای اسلامی با اشاره به آخرین وضعیت لایحه پلیس ویژه اطفال گفت: لایحه تشکیل پلیس اطفال برای بررسی بیشتر به کارگروه تخصصی ارجاع شده و نیمی از آن مورد بررسی قرار گرفته است.
<p class="rtejustify" style="box-sizing: border-box; font-size: 17px; margin-bottom: 15px !important; font-family: irsans; white-space: normal; word-spacing: 0px; margin-top: 0px; text-transform: none; font-weight: 400; color: rgb(33,37,41); font-style: normal; text-align: justify; orphans: 2; widows: 2; letter-spacing: normal; background-color: rgb(255,255,255); text-indent: 0px; overflow-wrap: break-word; font-variant-ligatures: normal; font-variant-caps: normal; -webkit-text-stroke-width: 0px; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial">به گزارش جهانی پرس از فارس، حدود ۳۰ درصد از جمعیت کشور را کودکان زیر ۱۸ سال تشکیل می‌دهند، این بخشی از اظهارات مظفر الوندی دبیر مرجع ملی کنوانسیون حقوق کودکان در سفر به کرمان است که گفته است:«کودکان افراد زیر ۱۸ سال هستند که امروز ۳۰ درصد جمعیت کشور را تشکیل می‌دهند و نگاه به آن‌ها بیشتر عاطفی است و کمتر به حقوق آن‌ها توجه می‌شود». براین اساس لایحه تشکیل پلیس ویژه اطفال و نوجوانان در ۴۹ ماده و ۶ فصل تدوین شده و در ۵ اردیبهشت ماه سال ۱۴۰۰ به تصویب هیأت وزیران رسید. این لایحه در ۲۶ اردیبهشت همان سال به مجلس شورای اسلامی ارسال شد تا در کمیسیون قضایی به تصویب برسد.</p>

<p class="rtejustify" style="box-sizing: border-box; font-size: 17px; margin-bottom: 15px !important; font-family: irsans; white-space: normal; word-spacing: 0px; margin-top: 0px; text-transform: none; font-weight: 400; color: rgb(33,37,41); font-style: normal; text-align: justify; orphans: 2; widows: 2; letter-spacing: normal; background-color: rgb(255,255,255); text-indent: 0px; overflow-wrap: break-word; font-variant-ligatures: normal; font-variant-caps: normal; -webkit-text-stroke-width: 0px; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial">در بحث کشف جرائم و تحقیق درباره آنها، تبصره 2 ماده 17 اشاره ای به معاونت یا مشارکت طفل یا نوجوان در برخی جرائم ارتکابی دارد و تأکید کرده که در این حالت، تحقیقات درباره طفل یا نوجوان خاطی از سوی پلیس ویژه و با همااهنگی سایر ظابطان دادگستری انجام می شود. ماده 19 این لایحه نیز درباره اختیارات پلیس ویژه اطفال سخن می‌گوید به طوری که صراحتاً تأکید کرده است که: «پلیس ویژه نمیتواند در جرایم مشهود، طفل کمتر از نه سال را دستگیر یا بازداشت یا بازجویی کند».</p>
<p class="rtejustify" style="box-sizing: border-box; font-size: 17px; margin-bottom: 15px !important; font-family: irsans; white-space: normal; word-spacing: 0px; margin-top: 0px; text-transform: none; font-weight: 400; color: rgb(33,37,41); font-style: normal; text-align: justify; orphans: 2; widows: 2; letter-spacing: normal; background-color: rgb(255,255,255); text-indent: 0px; overflow-wrap: break-word; font-variant-ligatures: normal; font-variant-caps: normal; -webkit-text-stroke-width: 0px; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial">اما در تبصره این لایحه قانونی تأکید شده که «دادستان باید در اسرع وقت و حداکثر ظرف (۷۲) ساعت بعد از دریافت گزارش تحویل طفل به اشخاص مذکور در بند (۲) این ماده، وضعیت وی را ارزیابی و حسب مورد به شرح زیر اقدام کند: صدور دستور برای یافتن ولی و بازگرداندن طفل به وی_ برگزاری جلسه با طفل و ولی وی_ معرفی طفل یا ولی وی جهت درمان، مشاوره یا دیگر برنامههای حمایتی مناسب به مراکز مربوط و اقدام لازم جهت تعیین قیم یا سرپرست در مورد افراد بیسرپرست یا بدسرپرست مطابق قوانین و مقررات مربوط.</p>
